1. Acceptance of Terms

Welcome to Bible Note AI. These Terms of Service ("Terms") govern your access to and use of the Bible Note AI mobile application ("App," "Service," or "Bible Note AI"). By downloading, installing, or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the App. We reserve the right to modify these Terms at any time, and your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

These Terms apply to users in the United States and Canada.

2. Description of Service

Bible Note AI is a mobile application that helps users organize and reflect on sermons, Bible studies, and religious teachings. The App provides the following features:

Audio recording of sermons and teachings
Upload of audio files in various formats (mp3, m4a, wav, flac)
AI-powered transcription of audio content
AI-generated summaries, key themes, and scripture references
Study flashcards for memorization
Journal prompts for personal reflection
Search and organization of sermon notes
Sharing capabilities for audio, transcripts, and summaries

The App is available for iOS devices and requires iOS 18.0 or later.

3. No User Accounts

Bible Note AI does not require user account creation or registration. You can download and use the App immediately without providing personal information.

However, you are responsible for maintaining the security of your device and any content you create or store within the App.

4. Subscriptions and Payments

Subscription Plans

Bible Note AI offers the following subscription options through Apple's In-App Purchase system:

Weekly Subscription: $4.99 per week with a 3-day free trial
Annual Subscription: $49.99 per year

Subscription pricing may vary by region and may change at any time. Current pricing is displayed in the App before purchase.

Billing Grace Period: We provide a 3-day billing grace period for subscription renewals. During this period, you will retain access to premium features while payment issues are resolved with the Application Store.

Free Trial

New users who select the weekly subscription receive a 3-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, you will automatically be charged for the subscription.

Automatic Renewal

All subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your Apple account will be charged for renewal within 24 hours prior to the end of the current period.

Managing Subscriptions

You can manage your subscriptions and turn off auto-renewal through your Apple ID account settings. To cancel:

Go to Settings on your iOS device
Tap your name at the top
Tap Subscriptions
Select Bible Note AI
Tap Cancel Subscription

Refunds

All purchases are processed through Apple's In-App Purchase system. Refund requests must be made through Apple. We do not have access to your payment information and cannot process refunds directly.

To request a refund from Apple, visit reportaproblem.apple.com or contact Apple Support.

5. Acceptable Use

You agree to use Bible Note AI only for lawful purposes and in accordance with these Terms. You agree not to:

Use the App in any way that violates any applicable federal, state, local, or international law or regulation
Upload or transmit content that infringes on any intellectual property rights or other proprietary rights of any party
Upload or transmit any material that contains viruses, malware, or other harmful code
Attempt to gain unauthorized access to the App, servers, or networks connected to the App
Interfere with or disrupt the App or servers or networks connected to the App
Use the App to harass, abuse, threaten, or intimidate any person
Upload content that is unlawful, threatening, abusive, harassing, defamatory, pornographic, or otherwise objectionable
Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App
Use any automated system or software to extract data from the App for commercial purposes
Resell, sublicense, or redistribute the App or its features

6. Content Ownership and License

Your Content

You retain all ownership rights to the content you create, record, or upload to Bible Note AI, including audio recordings, notes, journal entries, and any other materials ("Your Content").

By using the App's transcription and AI analysis features, you grant us a limited, non-exclusive license to process Your Content solely for the purpose of providing the App's services to you. This includes using AI services (such as OpenAI) to transcribe and analyze your audio content.

We do not claim ownership of Your Content, and we will not use Your Content for any purpose other than providing the App's services unless we have your explicit permission.

Third-Party Content

You are responsible for ensuring that any content you record, upload, or process through the App does not infringe on the rights of third parties, including copyright, trademark, or privacy rights.

If you record sermons or teachings, you should obtain appropriate permissions from speakers, churches, or content owners before recording and processing their content through the App.

Our Intellectual Property

The App, including its design, functionality, source code, and all related intellectual property, is owned by us and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms.

7. AI-Generated Content

Bible Note AI uses artificial intelligence to generate transcriptions, summaries, key themes, scripture references, flashcards, and journal prompts based on your audio content.

Accuracy and Reliability

While we strive to provide accurate transcriptions and meaningful analysis, AI-generated content may contain errors, inaccuracies, or misinterpretations. You should review all AI-generated content and use your own judgment.

Bible Note AI is a tool to assist with note-taking and reflection. It is not a substitute for careful listening, personal study, or spiritual guidance. The AI-generated content should not be considered as authoritative theological interpretation or spiritual counsel.

No Warranty

We make no warranties or guarantees about the accuracy, completeness, reliability, or appropriateness of AI-generated content for any particular purpose.

8. Third-Party Services

Bible Note AI uses third-party services to provide certain features:

OpenAI: For audio transcription and AI analysis
Apple In-App Purchases: For subscription processing and management
Firebase: For analytics and crash reporting

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices, content, or services of these third-party providers.

We reserve the right to change or discontinue any third-party services at any time without notice.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The App will be uninterrupted, timely, secure, or error-free
The results obtained from using the App will be accurate or reliable
Any errors in the App will be corrected
The App will meet your specific requirements or expectations

You assume full responsibility for any risks associated with your use of the App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING FROM OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bible Note AI, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any rights of another party, including intellectual property rights
Any content you upload, record, or process through the App

12. Data Loss and Backup

While we make reasonable efforts to maintain the availability and integrity of your data, we are not responsible for any loss, corruption, or deletion of your content, including:

Audio recordings stored on your device
Transcriptions and summaries stored on our servers
Journal entries, notes, or flashcards
Any other data created or stored within the App

You are responsible for maintaining backups of your important content. We recommend regularly exporting or sharing your sermon notes and other important content to external storage or backup services.

Automatic Data Deletion: Transcriptions and summaries stored on our servers are automatically deleted 30 days after creation. Please ensure you export any content you wish to keep long-term before this period expires.

If you delete the App from your device, all locally stored data will be permanently deleted and cannot be recovered.

13. Termination

You may stop using the App at any time by deleting it from your device. If you have an active subscription, you must cancel it through your Apple ID account settings to avoid future charges.

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Changes to the Service

We reserve the right to modify, suspend, or discontinue the App or any features at any time, with or without notice. We may also change pricing for subscriptions at any time, though changes will not affect your current subscription period.

We are not liable to you or any third party for any modification, suspension, or discontinuance of the App.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction to protect its intellectual property rights.

If you are a consumer in Canada, you may have additional rights under Canadian consumer protection laws, which these Terms do not override.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bible Note AI regarding your use of the App and supersede all prior agreements and understandings.
